Bathurst shooting judgement

A judge has thrown out a manslaughter case against two New Brunswick police officers in the shooting death of a businessman at the Bathurst train station.

Constables Patrick Bulger and Mathieu Boudreau wept and there was applause in the courtroom following the judge’s ruling.

The officers were each charged with manslaughter with a weapon, two counts of assault with a weapon and two counts of unlawfully pointing a firearm in the 2015 death of 51-year-old Michel Vienneau.

Judge Anne Dugas-Horsman ruled that the prosecution failed to make its case after a preliminary hearing.

NB passenger train concerns

New Brunswick VIA Rail passenger train service might be threatened due to a clause in a deal made 3 years ago by the former Alward Government.

That pact was made in order to upgrade track between northern and southern New Brunswick, to preserve freight service.

The deal says that CN could pull out of the province if freight levels drop over a two year period.

VIA passenger trains use the same tracks.

The clause does not kick in until 2019, when the company will compare freight levels against the 2012 ones.
