Wolfville firm wins an appeal

Kimball Law of Wolfville’s Derrick Kimball, a personal injury lawyer; has won a Supreme Court of Canada appeal.

The case involved Andrew Sabean of Lawrencetown, who lost his arm in a vehicle accident.

The appeal resulted in a unanimous 7-0 decision in favour of Sabean.

The Kimball team pointed out that the language in the insurance policy does not clearly state that CPP benefits will be classified as a policy of insurance, and deducted from Sabean’s insurance claim for personal injury.

Workers compensation in NS

A group fighting for injured workers wants an independent inquiry into the workers compensation system.

The Pictou County Injured Workers Association told a legislature committee the system needs an overhaul.  Mary Lloyd says the system is geared toward keeping down costs for a small number of large employers that account for most workplace injuries.

Her group called for such an inquiry in 2012 but it was rejected by the then NDP government as too costly and complex.
