Class-action suit in Air Canada accident

Transport Canada doesn’t think it should be one of the parties being sued by passengers of an Air Canada flight that crashed at the Halifax airport in March last year.

Lawyers for the passengers are seeking certification of a class action lawsuit against Air Canada, Transport Canada, the airport authority and Airbus for damages. Nobody was killed but over two dozen passengers were injured when the plane came down hard short of the runway.

Federal lawyers argued in court yesterday Transport Canada could not be sued because it did not owe a duty of care to the passengers or have a direct relationship with them.  The passengers’ lawyer Ray Wagner argues Transport Canada is responsible for reviewing and enforcing safety regulations.
