A body has been found near a vehicle owned by a missing man near Sunny Corner outside Miramichi. 84 year old Marcel Berthiaume has been missing since May20th. He was known to go for long drives in the woods in his Jeep.
Two hunters found his vehicle earlier this week. Then RCMP found human remains a short distance away. An autopsy is underway to confirm the identification. Foul play is not suspected.
The lawyer for Dennis Oland says he’s happy that the Supreme Court of Canada has decided it will not hear an appeal by the Crown.
The Crown had wanted to restore Oland’s conviction which was overturned by the provincial Court of Appeal last fall. Alan Gold had filed a cross appeal asking the high court for an outright acquittal. The high court refused to hear either one.
So now Gold and the prosecutor will start working on a getting a new murder trial set…probably not until next spring.
